All parties and websites mentioned above are hereafter referred to as "AW".

Purpose of this Agreement

AW has a Marketplace that allows Users to offer, sell and buy various goods. AW also allows members to purchase items from the Official Stores which are provided by third-party suppliers.

The provisions of this Agreement outline the acceptable and prohibited use of these areas of the AW site(s) as well as informing you of delivery/returns information for the Official Stores.

Definitions

Within this Agreement, Buyers may also be Sellers and Sellers may also be Buyers. Therefore, both Buyers and Sellers are collectively referred to as Users and/or Members, unless specific terms only apply to either Buyers or Sellers, which are referenced accordingly herein.

The Marketplace is the area of the site where User-to-User Sales/Auctions can be conducted. Official Stores orders are fulfilled by our suppliers. The Marketplace and Official Stores are collectively referred to as the “Mall”.

A “Sale” is where an item is listed for a designated price by the Seller and purchased by the Buyer. A “Random Winner Sale” is similar to a raffle where Buyers essentially are purchasing a chance at winning the item, more information on that here.

An “Auction” functions in the same way as you would expect; Buyers place bids to win the Auction and receive the item. Sellers can select a minimum bid value and reserve price for each Auction.

Terms and Conditions of the Marketplace

If you participate in an Auction or Sale, you are acknowledging that you have read, understood and accept this Marketplace Agreement.

This Agreement should be read in the context of the Site’s Policies & Agreements as a whole. If there are any inconsistencies between them, the AW Site(s) User Agreement, which expresses your rights and obligations more completely, will take precedence over this Marketplace Agreement.

Bids, Purchases and Payment

Bids and Purchases

Unless otherwise specified in this Agreement, bids placed on all Auctions and all purchases made will be binding. This means that if a bid is placed in an Auction or purchase made in a Sale through your AW account, whether by you or someone who uses that account, the bid/purchase may not be withdrawn and is binding. If your bid is successful, a contract is automatically created between you and the Seller when the Auction closes. With a Sale, the contract is made at the point of committing the purchase.

It is the receipt by the AW system of the relevant bid/purchase which will constitute the bid/purchase, not the dispatch of the bid/purchase from the Member's computer or other device. AW will use its reasonable endeavours to process bids and purchases which are placed but does not guarantee that each individual bid/purchase will necessarily be submitted.

Payment

When a Sale is made or an Auction ends, the relevant amount of credits will be debited from the Buyer. These credits will be held in escrow, where neither party can access them, for 7 days after the item has been marked as despatched. If the Buyer has not advised us of non-delivery within those 7 days after despatch, the credits will be transferred to the Seller.

All Auction items and Random Winner format sale items require the winner to enter their delivery details within a period of 7 days from the date the Auction ends or the Random Winner is selected/published. If the Buyer does not enter the delivery details and the Seller is unable to contact them, the credits will remain in escrow for 28 days, after which time the Seller will become entitled to them.

Disputes Between Users

In the event of a dispute it will be up to the Buyer and Seller to resolve the dispute and advise of the required action with regard to the transfer of credits.

AW does not intervene unless either Member is able to provide supporting evidence to verify their claim or in other exceptional circumstances.

Returns

In all circumstances Sellers and Buyers are required to agree the disputes and any return shipping costs between themselves and notify AW is the instance where some action is required from AW.

Abusing AW

You must not bid in a way that is manipulative of an auction. In particular, if you are the Seller, you may not bid in your own Auction, whether through your own AW account, or through another Member's account.

Without limiting our access to additional remedies, we reserve the right to suspend or terminate your user account, limit your ability to access the Marketplace, cancel bids, remove or restrict visibility of your listing(s) and take any necessary technical or legal measures to restrict your ability to use the services of AW if it is reasonable for us to believe that:

  • Your listings fall under the category of Prohibited Listings.
  • You are creating or are likely to create problems for the site and/or legal liabilities.
  • You are infringing third party rights.
  • Your account is not genuine and we cannot verify information you provide to us.

Listing Items for Sale

The placement of a listing, with items included for an Auction or Sale, through your AW account (whether by you or someone who uses that account) is binding and may not be withdrawn or changed once the first bid/purchase in that Auction/Sale is placed or made.

We reserve the right to withdraw a listing, even during the course of an Auction/Sale, which appears to be in breach of the Site’s Policies & Agreements. In that event, we will inform the Seller and potentially, where an Auction is being conducted based on that listing, one or more Buyers participating in that Auction of the withdrawal in question.

Prohibited Listings

The facilities within the Marketplace i.e. Auctions, Sales and Random Winner items are for tangible goods only. Tangible goods are those items that can be physically delivered to an address using the postal system.

These items listed below cannot and must not be sold via the Marketplace or Member's profiles.

  • Access to social media profiles or apps like SnapChat etc.
  • Advice, spells, curses, hexing, conjuring, magic, prayers, blessing services, magic potions & healing sessions
  • Animals and Wildlife Products
  • Bank Cards, credit, debit, pre-paid or otherwise
  • Bodily Fluids (including indirect references) or any parts, shavings, clippings or other products of the body.
    • Used underwear and clothing may be sold but not those that include any of the above (the items must be clean without any marks of bodily fluids)
  • Children's items (including clothing, uniforms & toys), including adult-sized school uniforms
  • Condoms (new or used)
  • Content or services including, but not limited to;
    • Webcam sessions & video calls
    • Phone Chat sessions
    • Chat-based sessions such those via SMS or instant messenger
    • Videos and pictures, whether custom or not, including DVDs, Blu-Ray, CDs (Adult or Non Adult)
    • Services defined in the Other Services role
    • Unauthorised Copies (audio and video content, including 'backup copies')
  • Counterfeit & Replica items (including clothing, jewellery, currency & stamps)
  • Drugs:
    • Alcohol
    • Tobacco/Tobacco Products & Paraphernalia (e.g. papers, filter tips etc.)
    • Drugs or Drug Paraphernalia
    • Herbal remedies
    • Herbal performance enhancers
    • Pharmaceuticals, including Viagra and Cialis or any prescription drugs and generic variants of them
    • Vitamins or other supplements (excluding products containing these, such as moisturisers)
  • Donations, Tributes, Monetary Gifts, Vouchers or Gift Cards
  • Escort related activities (bookings, deposits, random winner items) involving time or companionship meetings as a reward
  • Firearms, Ammunition, Weapons & Knives
  • Food/Drink Items
  • Government IDs, Licences and Uniforms
  • Halloween items, real or fake that resemble real-life hazardous activities or items, that could promote or support violence, but not limited to:
    • fake blood, blood stains, red ink
    • plastic weapon toys
  • Hazardous & Restricted Items
  • Home-made consumables such as creams, lotions and anything to be ingested or applied topically
  • Lighters or other fire-starters
  • Lottery Tickets
  • Mailing Lists and Personal Information
  • Multi-level Marketing, Pyramid, Matrix and Trading Schemes
  • Offensive Material
  • Satellite, Digital and Cable TV Decoders
  • Stolen Goods/Items
  • Surveillance Equipment
  • Travel tickets, Holidays, Sporting & Event Tickets
  • Unlocking Software
  • Any other items for which is it illegal to sell or purchase in the country from which you are accessing this site and/or will have any products delivered to.

Important Notes

Even if you offer to give away for "free" (rather than sell) a prohibited item, this will not relieve you of potential liability. This applies to both Seller and Buyer.

This list is updated from time to time and is incorporated by reference into the various website use agreements. Terms and Conditions of the Official Stores

The Official Stores are bound by the same Prohibited Listings with exception to the provision of condoms, which will only be sold as new.

Delivery & Returns Information for the SexToys Official Store

Delivery

We will endeavour to dispatch all orders that are placed before 4pm on the same day, Monday to Friday. Orders that are placed on a Friday after the cut-off time will be shipped on the following Monday.

There are three options for UK delivery:

  • £2.95 for Royal Mail 48 Tracked Delivery usually taking 2-5 working days
  • £4.95 for Royal Mail Tracked 24 Delivery, delivered next working day*
  • £5.95 for Interlink Next Day Tracked Delivery, delivered the next working day*

* 2 working days for certain AB, DD, FK, TD, PH postcodes, Northern Ireland, the Highlands and Islands of Scotland, and the Isles of Scilly.

European orders are delivered for £10 GBP by Royal Mail within 3-10 working days. Delivery to the rest of the world costs £19.95 GBP and usually takes between 7-10 working days.

All delivery prices are exclusive of VAT which will be applied at checkout. Please note that items delivered outside the UK carry a weight limit (2kg for Europe, 1.5kg for outside Europe), items over these limits may incur extra delivery charges and customs fees. We will contact you regarding any extra charges where applicable.

Missed Deliveries

Royal Mail

Royal Mail will hold your order at one of their Customer Service Points for 18 days if they have been unable to deliver to you or you do not collect your order. After this time the item(s) will be returned to the shop and we will contact you regarding how you wish to proceed.

If at this point you wish to cancel the order it will be subject to the Returns policy below, specifically the Unwanted goods section.

Interlink (now DPD)

DPD have a variety of options available if you miss your delivery, according to their terms if they are unable to contact you or come to an arrangement within a reasonable time (which unfortunately they do not specify) they have the right to dispose of/destroy the package or sell the contents if any monies are owed; anything beyond what is owed will be credited back to you though.

Orders sent outside the UK (Europe & rest of the world)

If the order was originally sent to Europe or elsewhere, the full shipping cost will need to be paid again so £10 GBP (+VAT) for the EU and £19.95 GBP (+VAT) for International orders.

Returns

Freepost return labels will be provided on your behalf for any returns, faulty or unwanted.

Unwanted goods

Any credit for goods returned to us as unwanted will be less a 25% restocking charge, subject to the following conditions:

- The goods must be unused

- The goods must be in their original condition & packaging (including shrink wrapping, seals etc)

- The goods must be received by us within 14 days from the day you receive your order (missed deliveries are exempt from this condition)

If we suspect that the goods have been used or any of the above conditions are not met then we reserve the right to return the goods to you. Items supplied in sealed packaging that have been opened are non-refundable and non-exchangeable.

Faulty goods

We operate a one year returns policy for faulty goods. Please send the item back to us with a note stating the problem, the desired outcome (exchange or refund) and the order reference number for the original purchase; which we will advise you of. We will exchange the item for you or credit your account if this is not possible. Please get in touch with us here for assistance.

You will not be charged any additional costs for the exchange of damaged or faulty goods.

Damaged goods & incomplete orders

All claims for delivery shortages and damages must be reported to us within 48 hours of the delivery date. Any claims of this nature that are outside of this time frame will not be honoured. Please get in touch with us here for assistance.

By placing a SexToys order, you also declare that you agree with the terms of the Marketplace Agreement.

Delivery & Returns Information for the Lingerie Shop Official Store

Delivery

Orders placed before 14:00 Monday to Friday will normally be despatched the same day. Orders placed after these times will be despatched on the next working day (Monday to Friday). All First Class UK orders should arrive next day or the day after, depending on where you live and the time of day you order. Orders shipped via First Class Recorded are not a guaranteed next day service.

  • 'UK Special Delivery 1pm Signed For' items are not delivered at the weekends, only Mondays to Fridays.
  • 'UK Special Delivery 1pm Signed For (Saturdays)' items are delivered on Saturdays.
  • All goods are wrapped discreetly. It will not be possible for anyone to identify the ordered goods, or their source from the outside.
  • All goods are despatched from the UK using Royal Mail.
  • Recorded Deliveries will require a signature upon delivery

Wishlist orders will not be despatched for 24 hours unless the Wishlist Delivery Address is updated/confirmed in the meantime. If that delivery address is updated/confirmed before 14:00 Monday to Friday the Lingerie Shop will normally despatch the same day.

Returns

Returns will only be accepted with a valid Returns Authorisation Number, which can be obtained here.

  • Return Numbers must be obtained within two weeks of delivery.
  • Faulty items will be replaced at no cost to yourself.
  • Exchanges for items of the same value (different size/colour) are permitted but you will need to pay the delivery charges.
  • Incorrectly shipped items or orders will be corrected at our expense.
  • Refunds will only be issued for non-faulty products if they have not been opened and are in a saleable condition.

Delivery & Returns Information for the Technology Shop Official Store

Delivery

We will endeavour to dispatch all orders that are placed before 2pm within 2 working days, Monday to Friday. Orders that are placed on a Friday after the cut-off time will be shipped on the following week.

There is only one option for UK delivery due to goods value:

£10 for Tracked Delivery, delivered the next working day from shipping*

All delivery prices include VAT.

 

UPS/APC/DPD

Faulty goods

All items sold via tech store are covered for at least 1 year from the manufacturer. Warranty and claim details for each product are included in the packaging and paperwork. Please contact the relevant manufacturer for assistance and support.

Dead on Arrival (DOA) – If a product is faulty and within 7 days of delivery, this maybe considered DOA, The relevant device manufacture will issue a DOA authorisation via their support line.

Once a DOA has been issued please send the item back to us with a note stating the problem, the desired outcome (exchange or refund) the order reference number for the original purchase and the DOA confirmation. We will exchange the item for you or credit your account if this is not possible.

Please note if no DOA is available the product will be sent back to the user to follow the manufacturer’s warranty process.

You will not be charged any additional costs for the exchange of damaged or faulty goods.

Damaged goods & incomplete orders

Liability Limitation

AW and services are offered "as is" and "as available", without any warranties or guarantees, express or implied. We and our suppliers specifically disclaim the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.

This does not apply to death or personal injury caused by our negligence and does not apply to any fraudulent misrepresentation by us.

AW is not and cannot be responsible for the behaviour of, or the items offered for sale or supply by, the Seller.

AW has no control over, and does not guarantee the existence of quality, safety or legality of goods advertised, accuracy of Users’ content, listings or information about the goods being offered. Even though Members are prohibited from doing so, some may provide information, or otherwise behave, in a way that is unreliable, illegal, or in breach of a Members' obligations under the Site’s Policies & Agreements.

AW cannot and does not control the completion or validity of transactions;

  • AW does not check the ability of Buyers to pay for items or Sellers availability of stock. As such, AW does not guarantee the transactions will take place. Users are alerted to exercise no lesser degree of caution in entering into transactions, whether as a Seller or Buyer, than you would exercise when entering into a similar transaction offline.

Disclaimer

AW does not and cannot have possession of anything listed or sold through the Marketplace or Official Stores. Marketplace Sellers and Buyers are urged to offer and use one of the Royal Mail recorded delivery services respectively.

Indemnification

The Buyer agrees that they will be liable for any losses howsoever incurred from accessing and/or using the AW site(s).

In no event shall AW (including our suppliers, officers, directors, employees) be liable for lost profits, revenues, or any special, incidental or consequential damages (however arising, including negligence) resulting from, or in connection with this Agreement or the use of the AW site(s).

You agree to indemnify and hold harmless AW, its officers, employees, parent companies, subsidiaries, contractors, vendors or affiliates, from any claim or demand, including reasonable solicitors fees, made by any third party due to or arising out of your use of the AW Auctions and Sales, the violation of the Site's Policies & Agreements by you, or the infringement by you or any other User of AW using your computer/account, of any intellectual property or other right of any person or entity.

AW, which is to include our parent, subsidiaries, employees, affiliates and directors, will not be liable to you in contract, tort, negligence or otherwise for any business losses, such as loss of revenue, profits, data, opportunities, goodwill, reputation or interruption of business or any other losses arising from:

  • Viruses or other malicious software acquired by accessing our marketplace or other area of the AW site(s);
  • Damage to your hardware device as a result of using AW;
  • Your usage of AW or your inability to use AW;
  • Delays or disruptions in our services and interruption of access of AW; including as a result of errors, problems with connectivity or any inaccuracies of any kind in our services; or
  • Pricing, postage or anything else related to your listing.

In the case where we are found liable, our liability to you is limited to the price of the item in the listing.

International Transactions

You, as a Buyer or Seller are responsible for complying with all laws and regulations applicable to international sales, purchases and postage of goods.

Validity of Provisions

If any clause or part thereof is held to be invalid, void or is unenforceable for any reason, it shall be struck out and shall not affect the validity and enforceability of the remainder of the Marketplace Terms & Conditions.

Changes to this Agreement

We may change this Agreement from time to time, either to add or remove specific types of Auction or Sale, or to alter the way that individual Auctions are conducted. Therefore, you should keep up to date with their content. If you have not yet participated in a type of Auction or Sale you find on AW, then we encourage you to read this Agreement before you take part. Indeed, even if you regularly buy or sell by Auction/Sale, you should take the time to read them. By taking part in an Auction or Sale, you indicate that you have done so and are obliged to comply with them.

Other AW Terms, Policies and Agreements

Other Terms, Policies and Agreements may apply to the supply of any products or services by the AW website(s) guest and/or registered Users.
